140cc Tao Tao dbx1 shifts into neural in any gear

Straight out of the box I have a Tao Tao dbx1 and it shifts into neutral even if you are in third or second gear then you have to keep slamming up and down the gear shift until it eventually finds a gear again tore the clutch side off and this is what it looks like does this look correct and what are some suggestions. I’ve seen on other videos of 125cc the star gear has a lever help holding it in place snd this doesn’t have that

So I do have some updates my friend actually bought the same bike at the same time his works fine was able to look inside his case and mine was shipped without a gear position lever it should be located behind the gear on the top left but the motor the sent is missing it. So now smartdealsnow from Amazon is giving me the run around on getting me a new motor make sure if you buy a bike it’s not through them just need the part really and I’ll be good to go but they don’t sell just that part
